What are the consequences, for contracting parties, of the invalidation of their agreement if they breached EU competition law ?

This book analyses this issue, as well as the basis on which, under the rules of national law, damages can be awarded to a contracting party, even though a party to an anti-competitive agreement should, as a rule, be considered to be the cause, not the victim, of the restriction of competition.

Invalidation of an agreement as a result of a breach of competition rules may occur when the contracting parties failed to properly determine whether or not their agreement complies with these rules. This book combines overview of the block exemption regulations recently adopted by the European Commission with practical guidance on the self-assessment process which should be conducted whenever an agreement may restrict or distort competition.
